The European Commission has proposed another amendment to Regulation 1223/2009, which includes restrictions on the use of: benzyl salicylate, citral or a ban on the use of triphenyl phosphate. The act is a proposal for now, but it is already worth preparing for potential changes in the formulation of cosmetics.

The European Commission has published another proposal to amend Annexes II, III, V and VI to Regulation (EC) 1223/2009. The changes include:

  • Annex II – prohibition of the ingredient triphenyl phosphate
  • Annex III – amendment of restrictions on the use of common ingredients: zinc salts, citral, geranial, neral, benzyl salicylate, and addition of several new entries, including colouring substances
  • Annex V – specifies the maximum use and conditions of use of Silver zinc zeolite as a preservative
  • Annex VI – amendment to the use of DHHB as a UV filter

Dates of application:

  • From 1 January 2027 cosmetic products containing substances subject to this Regulation proposal and not complying with the relevant restrictions or conditions will not be allowed to be available on the EU market.
  • From 1 July 2028 non-compliant products [Triphenyl Phosphate, Zinc Salts, Citral, Geranial, Benzyl Salicylate, Aluminium ingredients, Vetiveria Zizanioides Root Extract; Vetiveria Zizanioides Root Oil, DHHB] will no longer be available on the EU market. By then, they must be sold out.
  • From August 1, 2028. non-compliant products [Neral] will no longer be able to be available on the EU market. By then, they must be sold out.

At the moment, this is only a proposal, but it is already worth preparing for the potential implementation of the proposal as a binding legal act.
